Draft – Subject to Legal and Compliance Review

This document is a working draft prepared for KingXchange and THEKINGDELLY LTD. It has not been legally reviewed or approved, must not be relied upon, and requires confirmation across Nigerian, United Kingdom and European Union requirements before publication as final terms.

01

Who is responsible for your data

THEKINGDELLY LTD (RC 7011769, Nigeria) is the controller of personal data processed through KingXchange. You can reach us about privacy at thekingdellyltd@gmail.com or through the contact page.

This policy is a draft prepared for review. It describes the position we intend to take and has not yet been assessed by a data protection adviser in any jurisdiction.

02

The data we collect

  • Account data: email address, authentication details and email verification status.
  • Profile data: name, telephone number, country, and for businesses the company name and registration number.
  • Verification data: identity documents, proof of address, beneficial ownership information and the provider's verification result.
  • Transaction data: currency pair, amounts, quoted rate, payment references and settlement references.
  • Communications: enquiries, support tickets and complaints you send to us.
  • Technical data: limited logs needed to operate the site securely, such as timestamps and error records.
03

Why we use it and our lawful bases

We use personal data to create and administer your account, to verify identity, to calculate and record transactions, to prevent fraud and money laundering, to respond to enquiries, and to meet legal obligations.

Under the UK General Data Protection Regulation and the EU General Data Protection Regulation, our intended bases are: performance of a contract (operating your account), legal obligation (identity verification and record keeping), legitimate interests (security, fraud prevention, service improvement), and consent where we need it (for example optional marketing).

Under the Nigeria Data Protection Act 2023, we intend to rely on comparable bases: performance of a contract, compliance with a legal obligation, vital or public interest where applicable, and consent.

04

Verification documents

Identity and business documents are stored in private storage, not in a public location. Access is restricted to the personnel and, once appointed, the verification provider who needs it for a specific purpose.

We do not publish customer documents and we do not use them for marketing.

05

Who we share data with

  • Payment, digital asset settlement and identity verification providers engaged to deliver the service.
  • Professional advisers such as legal and accounting support, under confidentiality.
  • Regulators, law enforcement or courts where the law requires disclosure.
  • Technology providers hosting the platform and its private file storage.
06

International transfers

Some providers may process data outside Nigeria, the United Kingdom or the European Union. Where that happens, we intend to rely on the transfer safeguards recognised in the relevant jurisdiction, such as an adequacy decision or standard contractual clauses.

The specific transfers, providers and safeguards must be confirmed before live operation and documented by counsel.

07

How long we keep data

Account and transaction records are kept for as long as your account is active and afterwards for the period required by applicable anti-money-laundering and record-keeping rules.

Enquiries and complaints are kept for as long as needed to resolve them and to demonstrate how they were handled.

08

Security

Access to customer records is limited by role, administrative actions are recorded in an audit log, and documents are held in private storage. Data in transit is encrypted.

No system is completely secure. If a breach affects your personal data, we will notify you and the relevant authority where the law requires it.

09

Your rights

Depending on where you live, you may have the right to access your data, correct it, delete it, restrict or object to its use, receive a portable copy, and withdraw consent you have given.

You may also complain to a supervisory authority: the Nigeria Data Protection Commission in Nigeria, the Information Commissioner's Office in the United Kingdom, or the data protection authority in your EU member state. We would prefer the chance to resolve your concern first.

10

Cookies and tracking

The site uses the storage strictly necessary to keep you signed in and to protect forms against misuse. We do not currently run advertising or third-party analytics trackers.

If that changes, this policy will be updated and any consent required will be requested before tracking is enabled.

11

Children

The platform is not intended for anyone under 18 and we do not knowingly collect data from children.

12

Changes and contact

This draft will change as the service and its providers are finalised. The current version is always published on this page.
